The overturning of Roe v. Wade could have consequences on people undergoing IVF, as it may call into question the legal rights of embryos.through something called “personhood”. Personhood means that an embryo is considered a person at fertilization and thus could limit what you’re able to do with that embryo.
Currently, those who are trying to conceive have three options for their frozen embryos (1) implant them (2) dispose of them, or (3) donate them—either for research or to another intended parent.
In this new world, there’s a possibility that in states where abortion is illegal, patients could be forced to carry that embryo to term or pay for the storage of embryos in perpetuity. It’s even possible that those who discard embryos could be convicted of manslaughter for doing so. So far, no states have deemed embryos people outside of the womb, but we will be watching closely and updating you as things shift.

The overturn of Roe v Wade doesn’t only hurt those seeking abortions for viable pregnancies, it blocks women seeking medically-necessary abortions, those suffering from miscarriage, and could also impact those currently trying to conceive through infertility treatments like IVF. Other implications of this overturn are ongoing as legal battles determine new laws regarding abortion access and reproductive care on a state-by-state basis.
